Renegotiation of Section 106 Planning Obligations
In a move to try and kick start stalled housing developments the Government are proposing to allow formal requests for renegotiation of section 106 agreements agreed in more buoyant market conditions. The preferred route is for section 106 agreements to be renegotiated with local authorities on a voluntary basis. But where voluntary agreement cannot be reached formal requests for renegotiation would be allowed on planning obligations agreed prior to 6th of April 2010 – one month after new regulations taking effect. Currently such a formal request can only be made when an obligation is five years old. The local authority must take a decision on such a request and there is a right to appeal. Rutland Site Allocations Consultation
Rutland County Council is consulting on the Preferred Options version of its Site Allocations and Policies Development Plan Document (DPD). This document will identify specific sites to be allocated for housing and other types of development in Rutland and set out detailed planning policies for determining planning applications. Sites are identified for about 330 new houses. Release of these sites would be phased: Phase 1 (2012-2016) Oakham, Uppingham, Empingham, Ketton Phase 2 (2016-2021) Uppingham Phase 3 (2021-2026) Ketton, Greetham, Ryhall Sites are also identified for retail, employment and waste management. South Derbyshire have produced a Preferred Growth Strategy as part of their Local Plan preparation. This follows a review of population and housing growth conducted with Amber Valley Council and Derby City Council. The Council are consulting on four options (see graphic). Heseltine’s Planning Decision Medicine
No Stone Unturned: In Pursuit of Growth – is, as it’s author Michael Heseltine points out, one man’s attempt to set out a strategy for national wealth creation. Albeit that one man was asked to produce his report by the Prime Minster David Cameron no less. So in No Stone Unturned: In Pursuit of Growth how would Michael Heseltine speed up planning decisions? Remember this is someone, who, as a minister in the 1980s, famously said planners were “tying up jobs in filing cabinets”.
